सिविल वादों के निपटारे में होने वाले विलंब का एक प्रमुख कारण बार बार स्थगन दिया जाना माना जाता है। प्रक्रिया विधि न्यायालय को यह शक्ति देती है कि पर्याप्त कारण दर्शाए जाने पर वह सुनवाई को स्थगित कर सकता है, परंतु इस शक्ति के प्रयोग पर कुछ सीमाएं भी निर्धारित की गई हैं। सामान्यतः किसी पक्षकार को वाद की सुनवाई के दौरान तीन से अधिक स्थगन नहीं दिए जाने चाहिए और प्रत्येक स्थगन के कारण अभिलिखित किए जाने चाहिए। जहां स्थगन किसी पक्षकार के अनुरोध पर दिया जाता है, वहां न्यायालय उस पक्षकार को विरोधी पक्ष का खर्च वहन करने का निर्देश दे सकता है। केवल यह तथ्य कि अधिवक्ता किसी अन्य न्यायालय में व्यस्त है, सामान्यतः पर्याप्त आधार नहीं माना जाता। साक्षियों की परीक्षा प्रारंभ हो जाने के बाद अपेक्षा की जाती है कि सुनवाई दिन प्रतिदिन जारी रहे, जब तक कि उपस्थित सभी साक्षियों की परीक्षा न हो जाए। उच्च न्यायालयों ने अनेक निर्णयों में कहा है कि इन प्रावधानों का पालन अक्षरशः किया जाना चाहिए। न्याय की आशा लेकर आने वाला वादी यह अपेक्षा रखने का अधिकारी है कि उसके मामले का निर्णय उचित समय के भीतर किया जाएगा। सूचना के अधिकार से संबंधित विधि के अंतर्गत प्रत्येक लोक प्राधिकारी के लिए यह आवश्यक है कि वह ऐसे अधिकारियों को नामित करे जो नागरिकों से अनुरोध प्राप्त करें और मांगी गई सूचना उपलब्ध कराएं। अनुरोध लिखित रूप में अथवा इलेक्ट्रॉनिक माध्यम से किया जा सकता है और आवेदक से सूचना मांगने का कारण पूछना आवश्यक नहीं है। संबंधित अधिकारी निर्धारित अवधि के भीतर अनुरोध का निपटारा करेगा, चाहे वह निर्धारित शुल्क के भुगतान पर सूचना उपलब्ध कराकर हो या लिखित कारणों सहित अनुरोध को अस्वीकार करके। यदि मांगी गई सूचना किसी व्यक्ति के जीवन या स्वतंत्रता से संबंधित है, तो उत्तर देने की अवधि काफी कम होती है। यदि अनुरोध का विषय किसी अन्य लोक प्राधिकारी से अधिक निकटता से जुड़ा है, तो उसे उस प्राधिकारी को अंतरित किया जाएगा और आवेदक को इसकी सूचना दी जाएगी। अस्वीकृति के आदेश में यह उल्लेख होना चाहिए कि अनुरोध किस प्रावधान के अंतर्गत अस्वीकार किया गया है, अपील …

Clerical posts in the courts are filled through recruitments run by each High Court, either for itself or for the district courts in its state. Almost every one of these includes a typing test, and the passages are drawn from the kind of text courts produce every day: orders, notices and extracts from judgments. Practising with legal passages is therefore the most useful thing you can do before the test.

How court typing tests differ

Requirements change from state to state. A minimum of 40 WPM in English and around 30 WPM in Hindi is common, but some courts ask for less and award marks for every extra word per minute. Hindi-speaking states usually test Hindi typing, and many still accept Kruti Dev because court staff have used it for years.

Several courts also interview shortlisted candidates or test computer knowledge, but the typing test is often the stage where the most candidates are eliminated.

Legal vocabulary in Hindi and English

English passages are full of words like 'petitioner', 'aforesaid', 'adjourned' and 'hereinafter'. Hindi passages use वादी, प्रतिवादी, न्यायालय, अधिनियम, साक्षी and अभिलेख, with many conjuncts. These words slow down even experienced typists until they have practised them. Our court passages contain this kind of language on purpose.

Tips to pass the Court Clerk typing test

  • Collect a list of legal words from old question papers or court websites and drill them.
  • Practise typing case numbers and dates, which appear in almost every order.
  • If your state accepts Kruti Dev, confirm it in the notice before you commit to it.
  • Short tests reward a fast start; warm up for a couple of minutes before a mock test.
  • Read ahead by a few words so long legal words do not surprise you.
